BY ENTERING YOUR PURCHASE INFORMATION AND CLICKING THE ACTIVATE BUTTON, YOU AGREE TO THE TERMS OF THIS SPYSPOTTER ACTIVATION AGREEMENT (the "Agreement"). YOU AGREE TO THE PRIVACY POLICY AND THE TERMS OF THE END USER LICENSE AGREEMENT WHICH CAN BE FOUND AT THE SPYSPOTTER WEBSITE (www.spyspotter.com), INCLUDING, BUT NOT LIMITED TO, THE LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTY. YOU AUTHORIZE SPYSPOTTER, A DIVISION OF OEMTEC, LTD. (the "Company" or "SpySpotter") TO CHARGE YOUR CREDIT CARD. ALSO, YOU AUTHORIZE THE COMPANY TO AUTOMATICALLY CHARGE YOUR CREDIT CARD ANNUALLY FOR YOUR USE OF THE SOFTWARE. YOU AGREE THAT THE CHARGE IS NOT A SALE OF THE SOFTWARE. RATHER BY ENTERING INTO THIS AGREEMENT YOU HAVE A LICENSE TO USE CERTAIN FEATURES OF THE SOFTWARE FOR ONE YEAR. IF AFTER PURCHASING YOU WANT TO TERMINATE THE AUTOMATIC RENEWALS, PLEASE FOLLOW THE INSTRUCTIONS BELOW.

Commitment to privacy
SpySpotter software is dedicated to the importance of people's privacy while using their computer. The privacy statement of SpySpotter may be found on its website at (www.spyspotter.com/privacy.html) and is incorporated into this Agreement. This privacy statement governs the collection, use, and disclosure of information the Company collects from you. The privacy statement may change from time to time, and thus, it is recommended that you check this statement frequently.

Credit Card Information
SpySpotter uses Secure Server Software (SSL) that is among the best in use today by e-commerce Web sites. Your personal information, including sensitive credit card information, is encrypted so that it is indecipherable to others as it travels across the Internet.

Our Policies
SpySpotter accepts payment from Visa, MasterCard and American Express. At this time, these are the only forms of payment SpySpotter accepts. Once you hit the activate button, your purchase will be final.

Billing
You must provide SpySpotter with accurate and complete billing information including your legal name, email address, telephone number, and credit card/billing information. You must also report to SpySpotter all changes to this information within thirty (30) days of the change.

Charges
You are responsible for any charges to your account. SpySpotter is not responsible for any charges or expenses (e.g., for overdrawn accounts, exceeded credit limits, etc.) resulting from charges billed by us.

Default payment method
If you provide us with a bank account number or credit card number and expiration date to pay for your first purchase, you agree that such account will become your default payment method for your payment plan and all other purchases on our site.

Automatic Billing
By use of the software and by supplying bank account or credit card account numbers and expiration date, you agree to authorize automatic billing to charge you the subscription fee and all subsequent purchases automatically to the account registered as your default payment method, unless you choose another form of payment as your default payment method. You agree to pay, under the terms of the Agreement with that account's issuer, the amounts charged to your account. For renewals of the Software, you also agree to authorize us to charge the account listed as your default payment method (with a new expiration date, in the event the original card used to purchase the software expires, provided the account has not been cancelled by you or by the issuing bank).

Other Charges
Automatic billing described above shall apply to all charges, as well as any additional products, services, or upgrades purchased. Software, services, or upgrades purchased shall be billed to your default payment method on the business day of, or the business day immediately following, the purchase date.

Refunds
Refunds, if any, will be granted solely at the discretion of SpySpotter. If you are dissatisfied with this Agreement or any terms, policies, or practices of SpySpotter in operating the Software, any content available in the Software, or any change to any of the foregoing, your sole recourse is to cancel your use of Software and this Agreement. If during the first thirty days after your initial purchase, you are dissatisfied, you may cancel your purchase. If you cancel you software purchase and request a refund through our customer service department by emailing such request to billing@spyspotter.com prior to the thirtieth (30th) day after your purchase, the Company will issue you a refund. There will be NO REFUND of any sort if you request a refund thirty (30) days AFTER the initial purchase.

Renewal (and Cancellation of Renewal Charges)
For your convenience your subscription will automatically be renewed each year. You may cancel your renewal at any time. You will not be charged for any additional subscriptions, but will not receive a refund for any unused portion of your current year subscription. You may cancel your automatic renewal subscription by emailing billing@spyspotter.com and providing the Credit Card information used to purchase the SpySpotter program, including your name as it appears on your Credit Card. You may also cancel your automatic renewal subscription at any time by submitting a billing ticket at http://www.spyspotter.com/billing.php and providing the Credit Card information used to purchase the SpySpotter program, including your name as it appears on your Credit Card. To completely uninstall SpySpotter, please go to the following website for assistance: http://www.spyspotter.com/support.php . All SpySpotter sales are final purchases and non-refundable, unless otherwise stated.

Uninstall
You may receive instructions on how to uninstall your fully enabled or partially enabled Software by either (1) following the instructions at http://www.spyspotter.com/support.php or (2) emailing support@spyspotter.com and following the instructions you are given. Please note that uninstalling the Software does NOT cancel the automatic renewal charges. In order to cancel the automatic renewal charges, you must follow the instructions above.

Support
SpySpotter provides email support for users who purchase the software at support@spyspotter.com. SpySpotter does not provide telephone support.

Governing Law and Interpretation
This Agreement shall be interpreted under, governed under, and construed by the laws of Barbados, without regard to its rules governing the conflict of laws. Venue for any legal action shall be proper in Barbados and you and SpySpotter each expressly consent to venue and jurisdiction therein.

SpySpotter reserves the right to make changes to our site, policies, privacy policy, End User License Agreement, and this Activation Agreement at any time.

BY ACCEPTING THIS AGREEMENT, YOU AFFIRM AND ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS AGREEMENT. THE PROVISIONS CONTAINED HEREIN REPRESENT AN AGREED UPON ALLOCATION OF RISK WHICH IS REFLECTED IN THE FACT THAT YOU ARE RECEIVING A LICENSE TO USE SOFTWARE AND ASSUMING THE OTHER OBLIGATIONS HEREUNDER.

Reservation of rights. All rights not expressly granted in this Agreement are reserved by SpySpotter.
